Abstract:
This dissertation was submitted to the law faculty of the Eberhard-Karls University in Tuebingen in the summer of 2001. It contains the court decisions the german consti-tutional court made in questions of the law of the works council in authorities.
In 1959, the constitutional court of Germany had to judge the staff representation in public service act of the federal state of Bremen, and in 1995 it judged this act of the federal state of Schleswig-Holstein. Especially these two precedents are the most important for the development of the several acts of the different federal states.
The first decision is based on the principle of due course of law, the second one mat-ches the co-determination with the principle of democracy. This dissertation elucida-tes the similarities and the differences of both decisions.
