Zur Genese von Strafrechtsnormen

Abstract

Dieser Beitrag diskutiert verschiedene Theorien und Modelle, die sich mit der Entstehung von Strafgesetzen unter rechtssoziologischem bzw. kriminalsoziologischem Aspekt beschäftigen. Im Mittelpunkt steht der Übergang von einem Konsensmodell gesellschaftlicher Verhältnisse zu einem Konfliktmodell, das Normentstehung als Machtkampf zwischen verschiedenen Gruppen begreift. Das Konfliktmodell wird als nur bedingt geeignet betrachtet. Als ergänzendes und zugleich relativierendes Erklärungsmodell wird ihm an die Seite gestellt das Modell der Produktion von Strafrechtsnormen als Form staatlicher Machtausübung.

This article is dealing with different theories or models on the origins of penal laws stemming from sociology of law or sociology of crime. It begins with the so-called “consensus model” of society that is commonly attacked by the so-called “conflict model” regarding law-making as a power game between opposing societal groups or as a function of the wealthies’ interest. Since the autor considers the conflict model as lacking sufficient explanatory power he tries to develop an alternative or supplementary model. This model concentrates on the process of penal law norms’ production through particular forms of execution of state power and authority.
