Integration - Prävention : eine systemtheoretische Neubegründung der Strafe

Abstract

Die Theorien der positiven Generalprävention, die die derzeitige strafrechtstheoretische Diskussion beherrschen, können als Versuche gelten, die Legitimationskrise des Strafrechtssystems zu meistern. Die Hauptfunktion des Strafrechtssystems liegt nach diesen Theorien darin, durch kontrafaktisches Festhalten an verletzten normativen Erwartungen auf Kosten des Normbrechers das Rechtsvertrauen zu festigen und somit das Gesamtsystem zu stabilisieren.

The prevention-integration theories are seen by their supporters as an answer to the legitimation crisis of the penal system. With the functionalist-systemic theories in the background, the prevention-integration theories attribute to the penal system, and especially to punishment, the function of asserting the normative expectations and of observing the law, in other words the function of stabilizing the social System. Shifting the object of penal protection from interests and goods to functions, these theories appear functional to the expansive trends of the penal system.
