Abstract:
The claim of the abolitionism, to present a new paradigm is analysed and refused. The conservative function of the critique of treatment is shown. In the centre of the article is the analysis of renunciation of sanctions and the explanation of these facts with processes of change in domination and power. In these processes we notice loss of domination and winnings of power of different social strata. As contrasting, but not prevailing tendencies defense of domination, rewinning of power and sharpening of sanctions are discussed. In the balance, the different processes of change in domination and power in their consequences lead to the result of renunciation of sanctions in the „passive society“. Consequences of participatory justice are discussed.
