Verdacht, Gefahr und Risiko : Der V-Mann: Ein weiterer Schritt auf dem Weg zu einer anderen Polizei?

Abstract

Der aktuell verstärkte Einsatz von V-Leuten und „agent provocateurs“ wirft die Frage nach deren Funktion und Rolle im Kriminalisierungsprozeß auf. Aktuell scheint der Einsatz von V-Leuten und „agent provocateurs" besonders im „Vorfeld" der Strafaufklärung zu erfolgen. Eine Analyse dieses Vorfeldes zeigt aber, daß dieses aus Risikopopulationen besteht, welche durch spezifische soziale Indikatoren konstruiert werden. Damit knüpft der Kriminalisierungsprozeß durch V-Leute und agent provocateurs systematisch an legalen, aber riskanten Lebensweisen an und nicht an einem auf die konkrete Person bezogenen Straftatverdacht.

Traditionalpolicing did work too with the role of the V- Mann and agent provocateur as part of a reactive policing concept. The use of the V-Mann and agent provocateur in the presence is not a mere increase in the traditional forms of undercover activity but part of a proactive concept to detect and to screen risk populations. The beginning of criminalization so isn’t linked to a suspect in the traditional sense, but to the presence of specific social features who constitute a risk profile.
